(“Supervizor”) collects and uses the personal data you provide on our public website: www.supervizor.com (the “Site”), and any other website, feature, or services we offer that posts or provides this policy (collectively, the “Services”). It also describes the choices available to you regarding our use of your personal data and how you can access and update this information. We will share your personal data with third parties only in the ways that are described in this privacy statement. By visiting our Site, using our Services and submitting your personal data to us, you acknowledge and consent to our use of personal data as set out in this Privacy Policy.

What Data Do We Collect?

Supervizor may collect and process personal data from you directly when you visit the Site, automatically when you visit the Site, and sometimes from third parties. Some of this information may be considered “personal information” or “personal data,” and some of which may be considered “sensitive” under various applicable laws. We consider information that identifies you as a specific, identified individual (such as your name, phone number, and email address) to be personal information. We will also treat additional information, including IP addresses and cookie identifiers, as “personal data” or “personal information” where required by applicable law. Note that we may de-identify personal data so that it is non-personal, such as by aggregating. We maintain and use de-identified data without attempting to re-identify it, except where permitted by applicable law, such as to determine whether our de-identification processes satisfy legal requirements. We will treat de-identified information as non-personal to the fullest extent allowed by applicable law. If we combine non-personal information with personal information, then we will treat the combined information as personal information under this privacy policy.

We and our third party business partners (including any third party service providers or third party content, and analytics providers) may use a variety of technologies, including cookies and web beacons that automatically or passively collect information whenever you access or interact with the Site as a client or direct visitor to our website (“Usage Information”). Usage Information includes: the hardware model, browser and operating system you are using, the URL or advertisement that referred you to our Site, any search terms you entered into a search engine that led you to our Site, the areas within our Site that you visited, and the time of day you visited our Site, your time zone, non-precise location information, and mobile network (if applicable), among other information. We may also automatically collect your IP address or other unique identifier for any computer, mobile phone, or other device used to access our Site.

Most of this Usage Information is collected through cookies, web beacons, and other tracking technologies, as well as through your web browser or device (e.g., IP address, MAC address, browser version, etc.).
The tracking technologies employed when you use our Site may be first-party or third-party. The methods used to collect Usage Information may include the following:

Cookie and Log Files: A cookie is a small data file placed on a device when it is used to visit the Site or otherwise access our online content. Cookies may be used for many purposes, including, without limitation, remembering you and your preferences and tracking your visits to the Site. We may use both session and persistent cookies (which remain on your computer after the browser has been closed).

Supervizor uses cookies for purposes such as analyzing trends, delivering content, marketing, and advertising that may be relevant to your interests, administering the site, tracking users’ movements around the site and to gather information about our user base as a whole. We may run reports based on the use of these technologies by these companies on an individual as well as aggregated basis. We use cookies to improve our website and emails by seeing which areas and features are most popular, to count the number of computers accessing our website, to personalize and improve your experience, and to record your preferences. Our Site uses the so-called third-party cookies. These cookies are provided by third party service providers (including Google Analytics, HubSpot and Youtube) and will be used to improve the performance and design of the Site. Users can control the use of cookies at the individual browser level. You can make changes to which categories of cookies we use (with the exception of strictly necessary cookies) by clicking on the cookie pop-up window appearing on the bottom left-hand corner of the website to exercise your choices. As an alternative mechanism to control cookies, you may also edit the privacy and security settings of your browser where you can refuse to accept cookies, or remove cookies. However, our cookie preference center uses a cookie to remember the choices you have made. Consequently, if you delete all your cookies, we won’t be able to remember your cookie preferences and you will have to update them with us again.

Web Beacons. Small graphic images or other web programming code called web beacons (also known as “1×1 GIFs” or “clear GIFs”) may be included in our web pages and email messages. Web beacons may be used for a number of purposes, including, without limitation, to count visitors to the Site and to monitor how users navigate the Site.

Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Site, such as the links you click on. The code is temporarily downloaded onto your device from our web server or a third-party service provider, is active only while you are connected to the Site, and is deactivated or deleted thereafter.

Live Chat

Supervizor’s chat can record, use, and retain your information provided, as well as the communications within the chat, for purposes of assisting you during the conversation, to improve our products and services, market our services, and otherwise as necessary to respond to your inquiries. If you do not consent, please do not continue with chat assistance.

Session Recording Language

Supervizor may capture session interactions with user interfaces for website analytics purposes, solely for our internal business purposes, to improve the Site and our products and services.

Information Third Parties Provide About You

We may receive information about you from third parties, including business partners and data providers. We may also receive information about you from the company with which you are employed in connection with your relationship with us on behalf of that company. If you are on another website and agree to receive information from us, that site will forward your information to us so that we may contact you. We may also supplement the information we collect with outside records from third parties, such as public databases, publicly available social media pages, joint marketing partners, and third parties who enhance the information we have about you, in order to provide you with information, services or products you have requested, to tailor content, to offer you opportunities to purchase products or services that we believe may be of interest to you, and for other purposes. The information collected and stored by third parties is subject solely to the third party’s privacy practices.

Referral Features

You may choose to provide us names or other contact information of a colleague through the use of the Site (e.g. through the Resources section or other website forms) to take advantage of a referral, send product information, or through some other program. The information you provide (names, email addresses, etc.) is used to facilitate communication and is not used for any other marketing purposes, unless we obtain consent from that person. If you disclose any personal information relating to other people to us, you represent that you have the authority to do so and to permit us to use the information in accordance with this privacy policy.

How Do We Use and Share Your Data?

Supervizor uses the information we have collected about you through the Site, including personal data and Usage Information, for internal business purposes,such as:

  • providing and improving our products and Services, compile aggregate statistics, and improve the Site.
  • to communicate with you, respond to your requests, provide customer support
  • Account creation, management and maintainance

provide you with information about the Site and about Supervizor. We may use your information otherwise as disclosed in this Privacy Policy, for other reasons we disclose to you at the time of collection, and otherwise with your consent.

We may share your personal information with third parties as permitted or required by law, including:

(a) with external service providers that assist in operating our business (including, but not limited to, professional services consultant, advertising and marketing services, security vendors, and IT vendors);

(b) regulatory and government authorities, when we are obliged to disclose information to comply with the law or in response to a subpoena, court order, government request, or other legal process;

(c) to produce relevant documents or information in connection with litigation, arbitration, mediation, adjudication, government or internal investigations, or other legal or administrative proceedings;

(d) to protect the interests, rights, safety, or property of Supervizor or others;

(e) to enforce any terms of service or other legal disclosures on or related to the Site;

(f) to provide you with the services or products requested by you, and to perform other activities related to such services and products;

(g) to operate Supervizor’s systems properly; or

(h) any other sharing with your consent.

Supervizor may share information about you with its subsidiaries and affiliates, including for internal business and operational purposes. We may also transfer your information to another entity or its affiliates or service providers in connection with, or during negotiations of, any merger, acquisition, bankruptcy, sale of assets or any line of business, change in ownership control, financing transaction, or other transaction (including, without limitation, during the course of any due diligence process), without your further consent. By providing your personal data, you agree that we may transfer such information to the acquiring entity.

Third Party Advertising/Analytics Companies and Similar Third Parties

Supervizor works with third parties, such as advertising and analytics companies, who provide us with information about how our users interact with us and the Site and to provide information about the effectiveness of our ads. To do so, these third party business partners collect certain information about your visits to and activity on our Site. We may also share (or permit third parties to collect) certain information, such as Usage Information, aggregated, de-identified, or hashed information with these third parties for similar purposes. These third parties may set and access their own tracking technologies on your device (including cookies and web beacons) and may otherwise collect or have access to your personal information over time, including your visits to and activity on the Site as well as other websites and online services. If you would like to opt-out of third party advertising and analytics, there are a variety of tools available to you:

Do Not Track. Do Not Track (“DNT”) signals offered by some web browsers are settings that request that a web application disable its tracking of an individual user. When you choose to turn on the DNT setting in your browser, your browser sends a special signal to websites, analytics companies, ad networks, plug in providers, and/or other web services you encounter while browsing to stop tracking your activity.

Google Analytics. We use Google Analytics, which uses cookies and similar technologies to collect and analyze information about the use of the Site and report on activities and trends. These services may also collect information about the use of other websites, apps, and online services.

Your opt-out choices are browser and device specific; if you disable your cookies then upgrade your browser after opting out or if you use multiple different devices, please opt-out on each device and each browser separately.

Your Choices

You are responsible for maintaining the accuracy of the information you submit to us. The Site may include functionality to allow you to review, correct or update personal data that you have provided through the Site. We will make good faith efforts to make requested changes in our systems as applicable as soon as reasonably practicable or as required under applicable laws.

Marketing and Other Communications: If at any time you would like to unsubscribe from receiving future emails, you can click the unsubscribe link at the bottom of any email communication, or contact us using the contact information below and we will promptly remove you from all marketing correspondence. Please note that we reserve the right to send you certain communications relating to your account or use of our Site, such as administrative and service announcements, and these transactional account messages may be unaffected if you choose to opt-out from receiving our marketing communications.

Testimonials: We post customer testimonials on our website which may contain personal data (name, employer, photo, video). We do obtain the customer’s consent via email prior to posting the testimonial to post their name along with their testimonial. If you wish to request the removal of your testimonial, you may do so at any time by contacting us at compliancerequests@supervizor.com.

Security

We follow commercially reasonable security methods and technologies to protect the personal data submitted to us, both during transmission and once we receive it. This includes physical, procedural, and electronic safeguards. However, please remember that no method of transmission over the Internet, or method of electronic storage, is 100% secure. Thus, while we strive to protect your personal data, we cannot guarantee its absolute security and you use our Site and provide us with your information at your own risk.

Third Party Links and Services

The Site may contain links to and from third party websites that Supervizor does not control. The third parties whose content appears on the Site may collect information about you through the use of cookies and web beacons, may independently collect or solicit personal data, and may have the ability to track your use of their sites and services. We may collect Usage Information through Supervizor content appearing on third party sites. Please note that if you access a link to one or more of these websites, we do not accept any responsibility or liability resulting from you accessing an external link, as many of these websites have their own privacy policies that visitors of the websites are expected to adhere to.

Additionally, other privacy policies may apply when you engage with us through a promotional or marketing activity. Supervizor strongly recommends you read the privacy policies and terms and conditions of use of any third-party website or service to understand how your information will be collected, used and shared. We are not responsible for the privacy practices or the content on the websites of third-party sites.

Google API Disclaimer

The Site does not connect with Google Workspace APIs. To the extent that Supervizor’s products leverage Google Workspace APIs, such APIs are not used to develop, improve, or train generalized AI and/or ML models

General Audience Platform

The Site is not intended for the use of children under the age of 18. Supervizor does not knowingly collect personal data from any children under 18 years of age. If you learn that a child has provided us with personal data, then you may contact us as indicated below.

Notice to Users From Certain US States and Countries

Laws in certain jurisdictions give residents additional rights related to personal data. To make a request to exercise additional rights you may have, please see the section below that is applicable to you. If you live in another jurisdiction and wish to exercise certain rights available to you under local law, please contact us at compliancerequests@supervizor.com. We reserve the ability to limit our response to your request based on the law that is applicable to you.

California Privacy Notice

This California Privacy Notice is updated and effective as of: April 15, 2024

This California Privacy Notice (“Notice”) is for California residents and supplements our Supervizor Site privacy policy. If you are a California resident with whom we have a direct business or potential business relationship, this Notice applies to you. It explains how we collect, use, and share your Personal Information and how to exercise your rights under the California Consumer Privacy Act, California Privacy Rights Act, and its implementing regulations (collectively, the “CPRA”) Terms (including capitalized terms) used in this Notice have the same meanings given in the CPRA, unless otherwise defined.

Exercising Your California Rights

Under the CPRA, you have the following rights if you are a resident of California:

  • Right to Know: You have the right to request that we disclose to you the Personal Information we collect, use, or disclose, including the right to request that we provide to you the categories and specific pieces of Personal Information we have collected about you;
  • Right to Request Deletion: You have the right to request that we delete your Personal Information that we have collected about you;
  • Right to Opt-Out of Sharing: to opt-out from the sharing of your Personal Information to a third party for cross-context behavioral advertising (i.e., targeted advertising).
  • Right to Opt-Out of Sale: You have the right to opt out of the sale of personal information. Supervizor does not sell website data to third parties.
  • Right to Correct: You have the right to correct inaccurate personal information we hold about you.
  • Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to limit use and disclosure of Sensitive Personal Information, including that use which is necessary and anticipated to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services.

All rights above are subject to the meanings and exceptions set forth in the CPRA. More information on each of these rights is below.

In your request, you must provide enough information to allow us to verify you are the person about whom we collected personal information, or their authorized representative. You must also describe your request with enough detail so that we can understand, evaluate, and respond to it. Please note, we can’t respond to your request if we can’t verify your identity. Making such a request does not require you to create an account with us, and we will only use the information you provide in a request to verify your identity.

Verifying Your Requests

We will take reasonable steps to verify your identity based upon the information you provide and the type of request you are making. When you exercise your Right to Know, Right to Delete, and/or Right to Correct, we may ask that you provide us with information, beyond your full name, in order to verify your identity and fulfill your request. If we are unable to verify that the individual submitting the request is the same individual about whom we have collected information (or someone authorized by that individual to act on their behalf), we will not be able to process the request.

Agents

Under the CPRA, you may exercise these rights yourself or you may designate an authorized agent to make these requests on your behalf.

If you are an authorized representative submitting a request on a consumer’s behalf, please complete the applicable request per the instructions below. We will follow up to request a signed, written permission signed by the individual who is the subject of the request authorizing you to make the request on their behalf. The written permission must state your full legal name, the full legal name of the individual who is the subject of the request and needs to be clear about the permission granted. Alternatively, you may submit a copy of a power of attorney under Probate Code sections 4000-4465. In either case, please also indicate in your email the nature of your request. The California resident’s identity, in addition to your own, will need to be independently verified in order for us to be able to fulfill your request. We may also ask the California resident to directly confirm with us that they provided you permission to submit a request. Please keep in mind that if we do not receive adequate proof that you are authorized to act on the California resident’s behalf, we may deny the request.

Right to Know

California residents have the right to know what information we have collected about you (the categories and the specific pieces of information).

If you are a California resident with whom we have a direct business or potential business relationship and would like to exercise your Right to Know, please submit your request by emailing us at compliancerequests@supervizor.com.

In order to have us provide specific pieces of information, we may require a signed declaration under penalty of perjury that you are the California resident whose Personal Information is the subject of the request.

Right to Delete

California residents have the right to request that we delete information we have collected from you. If you are a California resident with whom we have a direct business or potential business relationship and would like to exercise your Right to Delete, please submit your request by emailing us at compliancerequests@supervizor.com.

Please note that as part of the verification process, once you submit a request to delete, we may follow up and require you to confirm that you want your information deleted.

Right to Correct Inaccurate Information

California residents have the right to request that we correct inaccurate information we hold about you. If you are a California resident with whom we have a direct business or potential business relationship and would like to exercise your Right to Correct, please submit your request by emailing us at compliancerequests@supervizor.com.

Do Not Sell or Share for Cross Context Behavioral Advertising

California residents have the right to opt-out of the sale and sharing of your personal information to a third party for cross-context behavioral advertising (i.e., targeted advertising). Note that Supervizor does not sell your personal information for monetary benefit. If you are a California resident and would like exercise your Right to Opt-Out of the Sale/Sharing of your personal information, please submit your request by emailing us at compliancerequests@supervizor.com.

Supervizor engages in online advertising practices (and certain analytics or similar activities), which may be considered a “sale” or “share” for cross-context behavioral advertising as defined in the CPRA. To opt out of certain tracking cookies set by 3rd parties that may be considered “sales” or “sharing” under the CPRA, please modify your cookie settings by clicking on the cookie pop-up window appearing on the bottom left-hand corner of the website or by clicking the “Do Not Sell or Share My Personal Information” link in our website footer.

In addition, the Digital Advertising Alliance also offers tools for California residents to send requests under the CPRA to opt out of the sale of personal information by some or all of the participating companies: https://www.privacyrights.info/.

Data Retention

We retain Personal Information for only as long as it is reasonably necessary for the purposes set out in this Notice and our Privacy Policy, considering the time period reasonably necessary to: provide the Site to you, exercise the choices and rights you have requested, comply with our contractual obligations, enforce our Terms of Use found on the Site, and comply with legal and regulatory requirements. Except where we have otherwise disclosed or agreed, we retain your personal information while you have an account with us, or while you are using the Site or our services or continuing to interact with us.

Data Deletion (and Destruction)

Personal data is deleted using secure deletion methods including, but not limited to, digital shredding of encryption keys and hardware destruction in accordance with relevant guidelines and applicable laws.

Supervizor does not knowingly collect, share, or sell Personal Information of users younger than 18 years of age.

Right to Non-Discrimination for the Exercise of Privacy Rights

California residents have the right to not receive discriminatory treatment for exercising CPRA rights. We will not discriminate against you for exercising your CPRA rights.

If you are based within the EEA, UK, or another jurisdiction with similar data protection laws, in certain circumstances you have the following rights: to be told how your information is used and obtain access to your information; to have your information rectified or erased or place restrictions on processing your information; to object to the processing of your information (e.g. for direct marketing purposes); to have the information you provided on an automated basis returned to you in a structured, commonly used and machine-readable format, or sent directly to another company, where technically feasible (“data portability”); where the processing of your information is based on your consent, the right to withdraw that consent subject to legal or contractual restrictions; to object to any decisions based on the automated processing of your personal data, including profiling; and to file a complaint with the applicable supervisory authority responsible for data protection matters.

Supervizor has a legitimate interest in using the information we collect for the purposes outlined above. Specifically, Supervizor has a legitimate interest in ensuring that its website continues to function efficiently and effectively, and to enhance the functionality of its website in response to how visitors use the website and collects data to that end. When you submit contact information to receive our white papers or other communications, we use that data to fulfill your request. We also have a legitimate interest in using data about the individuals who visit this website and the companies for which they work to cultivate business relationships that may benefit Supervizor. For some processing activities, such as communicating with you about opportunities to learn from or work with Supervizor, we seek your consent to process that data.

Supervizor is a French company with operations in the United States. If you use our Site outside of the United States, by using the Site and/or providing us with information, you understand, acknowledge, and agree that we may collect, process, and store your personal data in the United States and other countries for the purposes described in this Privacy Policy. By providing your information, you fully understand and unambiguously consent to this transfer, processing, and storage of your information in the United States and other jurisdictions, where laws regarding processing of personal data information may be less stringent than the laws in the country where you reside and/or are a citizen. Personal data information processed or stored in another jurisdiction may be subject to access requests from governments, courts, or law enforcement in accordance with the laws of that jurisdiction.

To safeguard your personal data from unauthorized access, collection, use, disclosure, copying, modification, disposal or similar risks, we have introduced appropriate administrative, physical and technical measures. We may retain your personal data for as long as it is necessary to fulfill the purpose for which it was collected, or as required or permitted by applicable laws. Residents of Australia/New Zealand

If you are based within Australia or another jurisdiction with similar data protection laws, in certain circumstances you have the following rights: right to access the data subject’s own personal data, right to rectify/correct the data subject’s own personal data where inaccurate or incomplete, right to erasure of personal data, right to restrict data processing, right to data portability, right to object to the processing of personal data and right to withdraw consent.
